Terms of Service Agreement

Terms and Conditions for Registered Artistes 

Your Contract with Us 

  1. Introduction Please read the following terms and conditions carefully. They constitute a binding contract (the “Contract”) between you (“you” or “your”) and Alessi Hartgian Casting Europe Limited (1597964) (“Alessi Hartigan Casting”, “we”, “us”, or “our”). 
  2. Acceptance By submitting your application to be registered as an artiste with ALESSI HARTIGAN CASTING, you agree to be bound by this Contract. 
  3. Registration and Work To apply for inclusion in our database of artistes (the “Database”), you must submit the online application form. Registration does not guarantee inclusion in our main casting directory or work offers. We make no guarantee of bookings, but will endeavour to provide opportunities as available. 
  4. Information and Eligibility Information provided on the ALESSI HARTIGAN CASTING registration form may be entered into the Database and used on our website and brochures. By creating a profile, you confirm that you are legally entitled to live and work in the UK and will upload proof of your right to work, such as a passport or visa. If your work hours are restricted, you must inform us in writing before accepting bookings.
  5. Criminal Convictions and Disclosure By applying, you confirm: 
  • You have no unspent criminal convictions (excluding driving offences), including under the Sexual Offences Act 2003. 
  • You are not on the sex offenders register and have not been subject to disciplinary action related to vulnerable groups. 
  • You agree to cooperate with requests for criminal record checks. 
  • You are either not allergic to make-up or prosthetics, or have informed us in writing. 
  • You have disclosed any material facts pertinent to your engagement or which could cause harm. 
  • You are legally entitled to live and work in the UK. 
  1. You consent to us publishing your details (including photographs) in the Database, on our website, and other materials, and sharing them with production companies and clients. 

Protecting Your Information 

  1. Data Protection We are the data controller under the Data Protection Act 2018 and GDPR. Your details will be used solely for purposes related to this Contract or as legally permitted, including contacting you about bookings and related services. We will implement appropriate security measures to protect your information and will not sell or trade your personal data.   2. Data Retention We will keep your details while you are on our Database and for up to two years thereafter. You may request removal of your details, but we must retain information related to your work for legal reasons. 
  3. Data Removal Requests Requests for data removal will be processed within 30 days. However, we must retain details related to work for legal reasons. 

Money Matters 

  1. Commission We will deduct a 20% (plus VAT) commission from all fees received for bookings arranged by us (“our commission”). 
  2. Payment Timing Commission is due on any work obtained through ALESSI HARTIGAN CASTING. We will endeavour to pay you within ten working days of receiving payment from the client. 
  3. Client Payments Payments are made only after receiving and clearing funds from the client. 
  4. Client Default We are not liable for bankrupt or defaulting clients but will make reasonable efforts to recover your money. 
  5. Payment Processing Payments may be made by different companies and may not follow the order of job completion. 
  6. Booking Failures You are responsible for any costs or waiting time if you fail to fulfill or are late for a booking. 
  7. No Show Consequences Failure to attend a booking without prior notice may result in removal from our register. 
  8. Direct Payments You should not receive direct payments from production companies or ADs. Notify us if this occurs, and we may invoice you for our commission.
  9. Pay Review You will receive a Pay Review detailing your earnings. Any discrepancies must be reported within 24 hours via email. 
  10. Dispute Resolution We will forward your queries to the production company and provide a response. We cannot enforce disputes where the production company disagrees. 

Your Responsibilities 

  1. Booking Attendance If you accept a booking, you must attend or inform ALESSI HARTIGAN CASTING at least 24 hours in advance if you cannot. Confirm your call time with us the day before. 
  2. Communication Acknowledge messages from ALESSI HARTIGAN CASTING and keep records of all bookings. 
  3. Punctuality: Arrive early for work and notify us immediately if you will be late.
  4. Sign Out On the workday, sign out if required and raise any queries about your hours or grade with the appropriate Assistant Directors.
  5. Booking Confirmation Confirm bookings and call details by 6pm. If you are replaced, contact the emergency contact to confirm your availability.
  6. Profile Accuracy Maintain accurate and up-to-date profile details, including measurements and photographs. 
  7. Contractual Agreements Your engagement is subject to a separate contract with the production company. Failure to sign their contract reverts to this agreement.
  8. Production Company Agreements You may need to sign additional agreements with production companies. If unable, you authorise ALESSI HARTIGAN CASTING to sign on your behalf. 
  9. Sex Offenders Register Confirm that you are not on the sex offenders register and inform us of any relevant changes. 
  10. Disabilities and Health Concerns Inform us of any disabilities or health concerns so we can offer suitable roles. 
  11. Behaviour Any inappropriate behaviour may result in removal from our register or non-payment by the production company.

Payments and Rates Quoted to Artists 

  1. Commission and Deductions We will deduct a 20% (plus VAT) commission from all fees for bookings arranged by us. Rates quoted are before deductions, including commission, agency fees, and National Insurance. 
  2. Booking Offers We are not obligated to offer bookings and may contact you with offers.
  3. Payment Processing Payments are made via BACS. Check bank statements and remittance advice carefully. 
  4. Payment Alessi Hartigan Casting will pay through the BACS system direct into your bank account. In association with our software partner, ES International Limited, You will be sent a remittance advice detailing what has been paid into your account.
  5. Payment Queries Report any non-receipt of payment immediately. Payments may take 30-90 days to process. 
  6. Direct Fees Notify us if you receive fees directly from a production company. We will invoice you for our commission where applicable. 
  7. Salary Vouchers Retain and return salary vouchers as required. Failure to do so may result in non-payment and commission invoicing. 
  8. Online Payments Payments will be processed through our online platform ‘Vouchers’. Review and query your pay within 24 hours. 
  9. Tax and National Insurance As a self-employed individual, you are responsible for your own tax and National Insurance. You are not an employee of ALESSI HARTIGAN CASTING. 

Press and Publicity 

  1. Confidentiality Do not disclose details about any production without permission. This includes prohibiting recordings, contacting media, or posting on social media.
  2. Breach Consequences Breaches of confidentiality may result in termination of your employment and this Contract.
  3. Phone Policy Cellular devices are not allowed on set. Phones must be kept in holding at all times unless otherwise permitted by production. 
  4. Photography No photos are allowed on set, in holding, or while in costume. Any photography that could disclose confidential information is strictly prohibited.

Any violation of these policies will result in the termination of your relationship with Alessi Hartigan Casting and may lead to penalized damages. 

Miscellaneous 

  1. Additional Agreements By accepting a booking, you agree to adhere to any additional production company agreements. If unable to sign, you authorise ALESSI HARTIGAN CASTING to sign on your behalf. 
  2. Insurance Production companies are responsible for personal injury insurance. ALESSI HARTIGAN CASTING is not liable for injuries, loss, or theft. 
  3. Health and Safety Report health and safety risks immediately. We will address such reports with the production company. 
  4. Subcontracting You cannot subcontract or transfer your rights or obligations under this Contract. 
  5. Waivers Failure to enforce any term or waiver of a breach does not prevent later enforcement. 
  6. Invalid Provisions If any provision is invalid, the remaining provisions remain in effect. We may replace invalid provisions with similar ones. 
  7. Contractual Relationship This Contract does not create an employment, partnership, or joint venture relationship between us. You do not have authority to bind ALESSI HARTIGAN CASTING. 
  8. Set-Off We may deduct sums owed from any fees received on your behalf and will notify you. 
  9. Third-Party Rights This Contract does not confer rights or benefits on any third party.
  10. Entire Agreement This Contract constitutes the entire agreement and supersedes all previous agreements. It is governed by English law, and the parties submit to the exclusive jurisdiction of English courts. 
  11. Contract Updates ALESSI HARTIGAN CASTING may update these Terms and Conditions. By accepting work offers, you agree to the latest terms. 
  12. Invalid Clauses If any clause is invalid, it does not affect the remaining clauses, which remain enforceable. 
  13. Background Checks Certain studio productions may require Support Artists to complete a background check before being approved for work. If applicable, Alessi Hartigan Casting will notify individuals on a case-by-case basis, in compliance with United Kingdom law
